Acknowledgement and Assumption of Risk*
I do hereby acknowledge that I am aware of the dangers and the risks to my person and property involved in participating in activities taking place (or that may take place) at an Image Reborn, Inc. d/b/a Image Reborn Foundation (“IRF”) retreat, including, without limitation, yoga, walking, physical movement and massage (collectively, the “Activity” or “Activities”). I understand and am aware that the Activities involve certain risks for injury to me, including the risk of serious injury, disability and death and property damage. I am also aware of the contagious nature of bacterial and viral diseases including, without limitation, COVID-19 (collectively, “Disease”) and the risk that I may be exposed to or contract a Disease by engaging in an Activity, which may result in serious illness, injury, disability, death and/or property damage. By participating in an Activity, I acknowledge that I may be increasing the risk of contracting a Disease.
I further understand that there are potential risks that may presently be unknown from, or involved in, participating in an Activity. Because of the dangers of participating in an Activity, I recognize the importance of complying, and agree to fully comply, with applicable laws, policies, rules and regulations, and any IRF or Releasee instructions regarding participation in an Activity, including instructions related to social distancing precautions, wearing face coverings, physical separation and sanitization. I understand that IRF does not provide insurance for participants in the Activity, that any insurance coverage would be through personal insurance, and IRF has no responsibility or liability for injury or illness resulting from an Activity. Notwithstanding these risks, I acknowledge that I voluntarily elect to participate in Activities with knowledge of the dangers involved, and I hereby agree to accept and assume any and all risks of INJURY, ILLNESS, DISABILITY, DEATH AND/OR PROPERTY DAMAGE ARISING FROM THE ACTIVITY AND MY ENGAGEMENT IN THE ACTIVITY, WHETHER ARISING OUT OF OR CAUSED BY THE ORDINARY NEGLIGENCE OF IRF, ANY RELEASEES OR OTHERWISE.
I am in proper physical condition to participate in the Activities, and am aware that participation could, in some circumstances, result in physical injury, serious physical injury or death. I understand my physical limitations and am sufficiently self-aware to stop physical activity becoming ill or injured. I have been advised to consult my physician before participating in the Activities. I have either consulted a physician as advised or have determined to proceed at my own risk without the benefit of prior consultation with my physician.
Waiver of Liability and Indemnification: In consideration for being allowed to voluntarily participate in the Activities, on behalf of myself, my personal representatives, heirs, next of kin, successors and assigns, I forever: a. waive, release and discharge IRF, its board members, agents, officers, coaches, employees, contractors, providers, facilitators and owners and lessors of the premises (collectively, “Releasees”), from and against any and all liability, claims, losses and damages of any nature (collectively, “Claims”) for my disability, injury or illness, property damages, property theft, death or claims of any nature which may hereafter accrue to me, and my estate as a direct or indirect result of participation in the Activities, whether arising out of or caused by the ordinary negligence of IRF, any Releasees or otherwise; and b. agree to defend, indemnify and hold harmless IRF and the Releasees from and against any and all Claims of any nature including all costs, expenses and attorneys’ fees, which in any manner result from my actions during an Activity or participation in the Activity.
I affirm that I am freely signing this Acknowledgement and Assumption of Risk. I have read this Acknowledgement and Assumption of Risk and fully understand that by signing this Acknowledgement and Assumption of Risk I am giving up legal rights and/or remedies which may otherwise be available to me, regarding any losses I may sustain because of participation in the Activity. I agree that if any portion of this Acknowledgement and Assumption of Risk is held invalid, the remainder will continue in full legal force and effect. All matters arising out of or relating to this Acknowledgement and Assumption of Risk shall be governed by and construed in accordance with the internal laws of the State of Utah without giving effect to any choice or conflict of law provision or rule. Any claim or cause of action arising under this Acknowledgement and Assumption of Risk may be brought only in the federal and state courts located in Salt Lake County, Utah and I hereby consent to the exclusive jurisdiction of such courts.Photo Release * Throughout the weekend, we love to take photos so we can look back and remember our time shared. Sometimes, we may use photos for social media, on our website, or printed materials to help give other guests an idea of what to expect during a retreat.
Photo/Video/Written Testimonial Consent and General Release: On behalf of myself and my family, I do hereby give Image Reborn Foundation, without consideration or compensation, permission to use photographs, written testimonials, and/or videotape that may be taken, provided or recorded while I am attending the Image Reborn retreat for promotional, educational, or fundraising activities including social media. It is my understanding that these likenesses may be used to promote public and professional understanding and support of the program. I waive any right that I may have to inspect or approve the finished product or the use to which it may be applied. I hereby RELEASE, DISCHARGE, AND AGREE TO HOLD HARMLESS IMAGE REBORN, ITS AGENTS AND EMPLOYEES, FROM ANY LIABILITY FOR ANY USE OF THE PHOTOGRAPHS, VIDEOS AND WRITTEN TESTIMONIALS.
